Compliance with data protection rules is a matter of importance to the Fleming’s Hotel team. The following Data Protection Policy will inform you about details on the collection, processing and storage of your data on www.flemings-hotels.com.

I.  General
When you visit individual pages on our website, only access data will be transmitted to our servers, in particular the following access data: 

  • Browser type/ Browser version
  • IP address

No user profiles are created by the access data.  They merely serve as statistical analysis for operational and security purposes as well as to optimise our offerings.

II.  Personal Data Categories
Should you use our website for the purposes of booking hotel rooms, arrangements or other services, for example subscribing to our newsletter, you may be asked to provide personal information. In order to carry out our services, we collect personal data such as name, address, telephone number, email address, credit card number or other payment information and reservation data (such as arrival and departure date, location of stay, special requests regarding your service preferences) or other information that you voluntarily specify, for example, when you log in to our loyalty programme or leave us a message in the electronic guestbook.


III.  Use of Personal Data
We acquire your data in order to provide hotel services that meet your standards and wishes as a guest and visitor. With the collection of your personal data, the following main purposes will be pursued:

  • Provision of hotel services, such as handling and processing your reservations, orders and inquiries about hotel services and products

  • Provision administrative information, such as notifications of services, products and events which you participate in

  • Communications by mail or email on promotions and offers from Fleming's Hotels

  • Improvement of customer service and the personalisation of hotel products and services for you and other clients

  • For additional commercial purposes, including market research, improvement of products and services, data analysis, fraud prevention and monitoring

  • Management of membership in the “Fleming's Card” loyalty programme

If the stored data is no longer necessary for the above purposes, your personal information will be blocked from further use or deleted. Tax and commercial provisions which, if necessary, require longer retention periods, remain unaffected by this, as well as the use of your data for which you explicitly give your consent (for example, for newsletter distribution).


IV.  Disclosure of Personal Data
The disclosure of personal data shall be carried out without express consent only insofar as it is necessary for contract processing. Any further disclosure of personal data to third parties will not take place unless we are obliged to do so by court order or by law.


V.  Contact and Enquiry Form
If you use the contact or enquiry form on our website to contact Fleming’s Hotels, the personal data you have provided us within the scope of the services will only be used for this purpose. We will only use your data, such as name, email address and telephone number, for the processing of your enquiry/ies. Collection, storage and further processing of the data by our company beyond the processing of your enquiry will not occur. 

VI. Usage of the Guestbook
If you use the guestbook, we will only collect such personal data as is communicated to you. When publishing your comment or your guestbook entry, the email address you provide will not be published, but rather only name and place of residence you provided.


VII.  Newsletter
You have the option to subscribe to a newsletter on our website. To receive the newsletter, the provision of personal data (especially name and valid e-mail address) is required. Without your express consent, the newsletter will not be sent. After your registration, you will receive a confirmation link via email, which must be followed for final registration to our newsletter mailing list. Only then will you receive the newsletter.

You can unsubscribe from the newsletter at any time by either emailing us or clicking the unsubscribe link in the newsletter.


VIII.  Optivo Email Marketing Service
We use an email marketing service, “Optivo,” provided by the company optivo GmbH., Wallstraße 16, 10179 Berlin. If you make use of an offer on our website that requires entering your email address, it may be stored on Optivo’s servers. Optivo provides us access to this information exclusively, which we use to inform you about our services, future events, news and offers on the website. IX.  Password-protected area (Fleming’s Card)
Within the password-protected area, accessible under flemings.loyserv.com members of our loyalty programme “Flemings Card” can, among other things, see their score, manage and/or change their profile information and request assistance. Registration is required to access the password protected member area.


X.  Information, Modification and Revocation
Information is freely available to you at any time on the personal data we have collected and stored about you. If necessary, the German Federal Data Protection Act provides for a right to amendment, blocking or deletion of your personal data.

XI. Cookies

Google will use this information to compile reports on website activity for website operators, and to provide other website-related services. Google will also forward this information to third parties, if so required by law or if third parties process the information on behalf of Google. Google will not connect your IP address with other data held by Google.

We always use Google Analytics with the extension “_anonymizeIp()” so that IP addresses are only processed in a shortened form in order to exclude direct personal references. In that regard, it is ensured that in the context of a page view, no detailed IP address information is being transmitted by you.

XIII.  Further Google Analytics Functions for Display Advertising

We use the following Google Analytics functions for display advertising

  • Google Display Network Impression Reporting
  • Integration of DoubleClick Campaign Manager
  • Google Analytics Demographics and Interests reports

These reporting capabilities allow us to use and evaluate the data obtained in the framework of interest-based advertising from Google, as well as third-party visitor information on Google Analytics. The data includes information such as age, gender and interests.

You can deactivate Google Analytics for display advertising at any time and adjust the ads in the Google Display Network – to do so, go to the Ads Settings on the page  https://www.google.de/settings/ads.


XIV.  Google AdWords
This website uses “Google AdWords” from Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”) and conversion tracking within the context of analytics services. When you select an ad delivered by Google, a cookie is stored for conversion tracking (see XI. Cookies). The cookies used in the context of conversion tracking expire after 30 days, do not contain any personal data and are not used for personal identification. If our website is visited before their expiration, these cookies may be used to understand how the forwarding to our website happened (especially via ad clicks). All Google AdWords customers receive a different cookie.

Using the information that the conversion cookie obtains, conversion statistics will be created for AdWords customers who have opted for conversion tracking. This gives the AdWords customers information particularly on the total number of users who have viewed their ads and who have been forwarded to a site equipped with a conversion tracking tag. They will not, however, receive any information that can identify a user personally.

If you do not wish to participate in the tracking process, you can altogether disable the automatic setting of cookies in your browser settings. XV.  Integration of Google Maps
This website uses the service “Google Maps” from Google, Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”) to display maps or maps excerpts. The collection of your IP address is required for the display of the maps. We have no influence on the possible storage of IP addresses by Google Maps. We work with third parties that create anonymous user profiles the delivery of personalised, interest-based online advertising across multiple websites. Interest-based advertising is displayed to a visitor when he/she visits other websites of the respective Display Networks belonging to one of the following third parties:

The abovementioned third parties use cookies to conduct an analysis of website activity, which form the basis for the creation of interest-based ads (see XI. Cookies). XVII.   Integration of YouTube Plugins (Videos)
On this website, we use plugins from the video platform YouTube.de or YouTube.com, a service that – represented by the Google Inc. – is operated by YouTube LLC (headquartered in 901 Cherry Avenue, San Bruno, CA 94066, USA; “YouTube”). Using the plugin, we can include the visual content on this website that we published on Youtube.de or Youtube.com.

YouTube uses cookies for statistical data analysis, to create interest-based advertising, to prevent fraud and to improve user friendliness, among other things (see XI. Cookies).

When you visit a page of our website with an embedded YouTube video, a connection is made to the YouTube servers and the plugin will be shown on the page through communication with your browser. The plugins are identified on our website by the abovementioned names or by small stylised icons.

XIX.  ShareThis
On our website, we use a plugin from the company ShareThis Inc., 4009 Miranda Avenue, Suite 200, Palo Alto, CA 94304-1227 (hereinafter: ShareThis). This plugin allows you to post or share relevant content from our site on social networks such as Facebook, Twitter, WhatsApp, LinkedIn and Xing. The plugin is distinguished by the word “sharehis” or by a small stylised icon within our website.

If you use the ShareThis function while you are simultaneously logged in a respective social media service (for example, Facebook or Twitter), your visit to our site may be associated with your particular usage profile there. ShareThis itself does not retain personal information about you and conducts only anonymised usage statistics about the content you shared.

If you do not want your visit to our website to be associated with your social media profile and the content you share to be statistically recorded, simply do not use the ShareThis buttons.
